These General Conditions regulate the use of and access to the Internet service by the company AEIMIS at the following electronic address: www.aeimis.com.
1. Use of this Website
The operation of the website, www.aeimis.com, is governed by these general conditions, which are available to the user. The main purpose is to provide information about the services and the consortium responsible for the project. Using the website grants you the status of a user and implies your full acceptance of all Website Use Conditions in effect at the time you access it. Consequently, if you do not agree with any of the conditions set forth in this document, you should not use the website.
Additionally, you agree not to use the information published on the website for any illegal purpose or effect, in a way that is contrary to the content of these General Conditions, that may harm the rights or interests of third parties, or that could in any way damage, disable, overload, or impair the website or the information provided on it, or prevent other users from a normal use or enjoyment of the website.
You will refrain from obtaining information, messages, graphics, drawings, sound and/or image files, photographs, software, and, in general, any kind of material accessible through the website or its services, using means other than those that have been made available to you or, in general, those that are normally used on the Internet.
2. Right to Modify the Website, Restrict Access, and Suspend Operation
AEIMIS reserves the right to modify the presentation or configuration of the website at any time and without prior notice, as well as the information, services, these Website Use Conditions, or any other general or specific condition, instruction, or notice. These modifications will be made to improve services for the user, in line with market trends. In addition, AEIMIS reserves the right to suspend, interrupt, or make the website inoperative, or to restrict access to it, partially or completely, individually or collectively, temporarily or permanently, at any time.
3. Website Navigation Cookies
The service provider for the AEIMIS website only uses cookies to facilitate user navigation on the website. Under no circumstances will they be used to collect personal data. They are only used to improve navigation on the website and reduce the download time for web elements.
However, if you do not wish to use these cookies, you can configure your web browser options to prevent the system from using them. These files can also be deleted without affecting the quality of the website. The only effect of this setting is that the website will take longer to download, as the files will not be in your cache.
4. Website Access and Use are Free
The website service is provided to the user free of charge and does not require a prior subscription or registration. User identification is only necessary in the following situations: when you request more information about a topic of interest, send us an email to contact us, want to access the image publications available in our library, or ask us to send you press releases or press kits.
The registration and identification of your personal data will be governed by the provisions of section 10, titled “Policy on the protection of privacy and confidentiality of personal information that users provide freely and voluntarily.”
5. Links
The website may occasionally offer technical linking devices (links, advertisements, or buttons), directories, and search tools that allow you to access websites belonging to and/or managed by third parties. AEIMIS does not offer or sell, on its own behalf or through third parties, the services available on the linked sites. It does not control, supervise, or approve the products, services, content, information, data, files, and any other kind of material on these linked sites.
AEIMIS therefore disclaims all responsibility with respect to information outside this website that is not directly managed by AEIMIS.
If you wish to create a link or take a similar action with respect to the website, you must first be authorized by AEIMIS. Any other use, assignment to third parties, communication, and disclosure of the full or partial, public, or private content is prohibited. AEIMIS reserves the right to take the respective civil and criminal legal actions to demand compliance with this clause and to claim damages.
6. Intellectual and Industrial Property Rights
The user acknowledges and accepts that all industrial and intellectual property rights over the content and/or any other element included on the website (including, without limitation, trademarks, logos, trade names, texts, images, graphics, designs, sound, databases, software, flowcharts, presentation, “look and feel,” audio, and video) are the property of AEIMIS and/or third parties. In no case does access to the website imply any type of waiver, transmission, license, or total or partial transfer of these rights by AEIMIS and/or the third parties who own the website’s content, unless expressly stipulated otherwise.
7. Exclusion of Warranties and Liability
7.1. Regarding the Website’s Operation
AEIMIS does not guarantee the availability and continuous operation of the website and will not be liable for any damages or losses that may arise from (i) the lack of availability or accessibility to the website or to those sites with which a link has been established; (ii) the interruption in the website’s operation or computer failures, telephone failures, disconnections, delays, or blocks caused by deficiencies or overloads on telephone lines, the Internet system, or other electronic systems during its operation; (iii) the unsuitability of the website for the specific needs of users; and (iv) other damages that could be caused by third parties through unauthorized intrusions or hackers outside the control of AEIMIS.
AEIMIS does not guarantee the absence of viruses or any other element introduced by external third parties on the website that may produce changes in the users’ logical or physical systems or in the electronic documents and files stored on their systems, and it will not be liable for any damages or losses that may arise from the presence of viruses, malicious programs, or other elements that may cause alterations in the users’ logical or physical systems, electronic documents, or files.
However, AEIMIS adopts various protection measures to protect the website and its content from hackers. This does not, however, guarantee against unauthorized use by third parties to access the type of use of the website that the user makes or the conditions, characteristics, and circumstances in which that use is made. Consequently, AEIMIS will not be liable for any damages or losses arising from such unauthorized access.
7.2. Regarding Website Use
AEIMIS will not be liable in any case for the use that users and/or third parties may make of the website, or for the damages that result from it.
7.3. Regarding Content
The content of the website is the exclusive property of AEIMIS and is made available in good faith and following the best professional quality standards. However, AEIMIS excludes any type of liability for damages of any kind that may be due to the lack of truthfulness, accuracy, and/or current importance of the content on the website.
8. Partial Nullity
If any of these General Conditions are declared null, invalid, or without effect, this will not affect the validity or effectiveness of the other clauses, which will continue to be binding between the parties. The waiver by either party to demand compliance at any given time with any of the conditions stipulated here will not imply a general waiver of compliance with the other condition or conditions, nor will it create a vested right for the other party.
9. Applicable Law and Jurisdiction
The provision of the website service and these Website Use Conditions are governed by the applicable legislation in the territorial regulations of the European Union, and specifically by the laws that make up the Spanish legal regulations applicable to the information society and e-commerce services, as well as the Spanish legislation on personal data protection. In case of any discrepancy in the performance, interpretation, or compliance with these Conditions, or in the relationships between the user and AEIMIS, both parties expressly waive any other privilege that may correspond to them and agree to submit to the exclusive jurisdiction and competence of the Courts and Tribunals of Madrid (Spain).
10. Policy on the Protection of Privacy and Confidentiality of Personal Information that Users Provide Freely and Voluntarily
